General Terms and Conditions of Sale
The following provisions establish the general terms and conditions of sale for the products offered by Le Fil de Mathilde on its website at the following address: www.lefildemathilde.fr. The registered office is located at 2 Impasse Abbé Fauvel, 61600 Bagnoles-de-l’Orne – Normandie, and is registered with the Alençon Trade and Companies Register under Siret number 498 476 704.
These general terms and conditions of sale and use govern all use of the website and the services offered therein. We reserve the right to modify or delete, in whole or in part, these general terms and conditions of sale as well as the terms of use, at any time and without prior notice.
By continuing to use the website after such modifications, you signify your acceptance of the new Terms and Conditions.
It is your responsibility to consult this page regularly in order to check for any modifications to the terms and conditions and, where applicable, to take note of them.
Acceptance of the General Terms and Conditions of Sale, by clicking “Validate my cart,” constitutes final confirmation of your order.
Le Fil de Mathilde does not permit the sale of any product without prior acceptance of the clauses set out below.
ARTICLE 1 – PURPOSE
The present terms and conditions define the procedures of sale between Le Fil de Mathilde and the client, covering ordering, services, payment, and delivery. They govern all steps necessary to place an order and ensure the follow-up of this order between the contracting parties.
ARTICLE 2 – PRODUCTS
Le Fil de Mathilde offers embroidery kits for sale within the limits of available stock. Products offered are those available for sale on the date of consultation by the user. When a product is unavailable, this is indicated on the site; otherwise, in the event of an error, Le Fil de Mathilde undertakes to inform the customer by email as soon as possible. If the product has already been paid for, Le Fil de Mathilde undertakes to refund the customer the price of the item.
On our site, each product available for purchase is described on a dedicated page. We strive to represent all product characteristics as faithfully as possible using photographs and descriptions created by us. Before placing an order, we therefore invite you to carefully review the description, composition, and characteristics of the product. However, in the event of errors or omissions in such presentation, the liability of Le Fil de Mathilde shall not be engaged. The photographs illustrating the products do not constitute a contractual document.
ARTICLE 3 – PRICES
Prices are indicated in Euros including all taxes (TTC) and must be paid in Euros (together with all applicable taxes, including all duties and taxes paid on your behalf at the time of customs clearance). Prices include French VAT, applicable on the date of the order. Should the VAT rate be modified, such changes would be reflected in the price of the items. Le Fil de Mathilde reserves the right to modify its prices at any time. However, once an order has been validated, the prices cannot be altered.
Prices indicated do not include shipping costs or any additional charges, which will be added to the total order amount and specified to the client at the time of final validation of the cart.
Delivery within mainland France is carried out within an average of 1 to 7 days from receipt of the order by Le Fil de Mathilde, notwithstanding any case of force majeure or unforeseen circumstances delaying delivery beyond the control of Le Fil de Mathilde. Delivery costs depend on the country of delivery. Products remain the property of Le Fil de Mathilde until full payment of the price.
ARTICLE 4 – PURCHASE OF PRODUCTS / ORDERS
Orders are placed and received exclusively via the Internet on the Le Fil de Mathilde website and are processed by Mrs. Claire Brisard.
To validate an order, the client must follow this procedure: select the desired products, add them to the virtual cart by indicating the chosen quantities, and then click “Validate my cart.” The client must then complete the required personal information (Name, First name, Email, Delivery address) and finalize the order by providing payment information. The client may also add optional notes.
An order can only be registered if all required fields have been correctly completed.
Any order constitutes acceptance of prices, product descriptions available for sale, the General Terms and Conditions of Sale, and forms the contract.
All information required on the order page must be provided accurately. We cannot be held responsible for delivery delays resulting from errors in the delivery address. Any additional fees or costs arising from such delays shall be charged to the customer.
In all cases, regardless of the payment method chosen, Le Fil de Mathilde will acknowledge receipt of the order by email once validated. Any product included in the order but not listed in the confirmation email does not form part of the contract.
We reserve the right to refuse any order for legitimate reasons, particularly if the quantities ordered are unusually high for a consumer or in case of payment issues. We may also request additional documents to verify the identity of the customer.
We further reserve the right to refuse any order in the event that the price displayed (and paid by the client) is incorrect or abnormally low due to technical or computer malfunction, or for any other reason that Le Fil de Mathilde deems appropriate to explain to the client. In such cases, Le Fil de Mathilde cannot be held liable.
ARTICLE 5 – PAYMENT AND SECURITY OF TRANSACTIONS
Le Fil de Mathilde offers secure payment by credit card.
Payment Security
For payments by credit card, Le Fil de Mathilde verifies the reliability of information entered during order registration. The Customer Service department may request proof of identity and residence by email. Processing of the order will only begin upon receipt of the requested documents.
If the customer does not respond within seven (7) days, or if the documents provided are insufficient to confirm identity and residence, the order will be cancelled, and the customer will be informed by email.
Payment is made online on the website (lefildemathilde.fr) by credit card. The buyer must provide card number, expiration date, and security code. The full order amount will be charged to the card on the day of the order.
Le Fil de Mathilde reserves the right to suspend processing and delivery of any order in case of non-payment or refusal of authorization by accredited internet payment organizations.
Le Fil de Mathilde also reserves the right to refuse or cancel any order from a customer who has not fully paid a previous order or with whom a payment dispute exists.
Le Fil de Mathilde cannot be held liable for fraud or misuse of any payment method not detected by the verification process. The buyer guarantees that they are authorized to use the chosen method of payment.
Any fraudulent use of a bank card cannot give rise to reimbursement by Le Fil de Mathilde. Products remain the property of Le Fil de Mathilde until fully paid for.
Credit card payments are secured by Stripe, compliant with PCI-DSS standards. No banking data is visible to or stored by Le Fil de Mathilde.
When placing an order, the buyer is on Le Fil de Mathilde’s servers. When paying, they are redirected to secure servers.
ARTICLE 6 – SIGNATURE AND PROOF
Providing credit card details online and final validation of the order constitute proof of the entire order, in accordance with the law of March 13, 2000, and render the sums due enforceable. This validation constitutes signature and express acceptance of all operations carried out on the site.
In the event of fraudulent use of their bank card, the customer must contact Le Fil de Mathilde’s customer service immediately at boutique@lefildemathilde.fr.
Computerized records stored in Le Fil de Mathilde’s systems and those of its partners under reasonable security conditions shall be considered as proof of communications, orders, and payments between the parties.
In all cases, order validation and payment by credit card on the site constitute signature and express acceptance of all operations carried out on the site.
